1. Acceptance of Terms

By accessing or using MyFareWill (“the Service”, “MyFareWill”, “we”, “us”, or “our”), you (“you” or “the End User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users — visitors, registered users, and paying customers. You confirm that you are at least the age of majority in your jurisdiction and are legally able to enter into a contract. By using the Service, you confirm that any information you provide is true, accurate, and complete to the best of your knowledge.

2. Description of Service

MyFareWill is a self-help document-preparation service operated by Quietus LLC. We provide an online guided wizard that helps individuals create their own Last Will and Testament, Power of Attorney for Property, Power of Attorney for Personal Care, and related estate-planning documents (“Materials”).

For a one-time fee, depending on the plan you select, you receive the documents in PDF form, signing instructions specific to your province or state, free lifetime updates to your documents, and (where applicable) ancillary features such as executor claim codes for FarewellDesk and Couples Wills bundles. Plan details and current pricing are published at /will/checkout.

We reserve the right to add, remove, modify, or discontinue any part of the Service, or to modify these Terms, at any time. Material changes will be reflected by updating the “Last updated” date and the version string at the top of this page. Your continued use of the Service following any change constitutes your acceptance of those changes.

3. Self-Help Service — Not a Law Firm and No Legal Advice

MyFareWill is not a law firm. The information and document templates we provide are general legal information only — they are not tailored to your specific facts, do not interpret the law for your situation, and are not a substitute for the advice of a licensed lawyer or notary in your jurisdiction.

No lawyer-client relationship is created by your use of the Service. No employee, contractor, or representative of MyFareWill is authorised to provide legal advice. Any communication between you and us — whether by email, phone, live chat, support ticket, or otherwise — is not protected by solicitor-client privilege or any equivalent doctrine, and may be required to be disclosed in response to a legal process.

If your estate involves any of the circumstances described at /not-right-for-you — including blended-family planning, spousal trusts, tax-minimisation structures, dual wills, planning for a dependant with a disability, or disinheritance of a spouse or dependant child — you should not use this Service. 4. Payment, Pricing, and 30-Day Money-Back Guarantee

Fees for the Service are payable in advance via Stripe at checkout. Prices are displayed in the currency appropriate to your country, and Canadian customers may also pay with Klarna where eligible. Applicable taxes are calculated at checkout.

30-day money-back guarantee. If you are dissatisfied with the Service for any reason, you may request a full refund within thirty (30) days of your purchase from your dashboard at /dashboard. Refunds are processed via Stripe and typically appear in your account within 5–10 business days. Documents you have already downloaded will remain accessible to you, but your account will be marked refunded. The 30-day window begins on the date of payment and is calculated against the most recent purchase on the account.

Refunds outside the 30-day window are issued at our sole discretion. We reserve the right to deny refund requests we determine to be made in bad faith (for example, repeated purchase-and-refund cycles, or requests made after a will has been used as evidence in a legal proceeding).

Payment processing services are provided by Stripe Payments Canada, Ltd. and Stripe, Inc., and are subject to the Stripe Services Agreement at stripe.com/legal/ssa. By using the Service you agree to be bound by the Stripe Services Agreement as it may be modified from time to time. We do not store or have access to your full payment card details.

5. Lifetime Updates and Document Access

Your purchase includes free unlimited updates to your documents for as long as the Service is operated. You may log in at any time, edit your information, and re-generate your documents at no additional cost. We will retain your documents and draft data for as long as your account is active. If you delete your account, your documents and draft data will be deleted from our active systems within thirty (30) days, subject to retention requirements imposed by law.

6. Your Data Is Your Responsibility

The accuracy, completeness, and legal sufficiency of the information you enter into MyFareWill is your sole responsibility. We do not independently verify, investigate, or evaluate the data you provide. We do not draw legal conclusions, apply the law to your facts, or review your Materials for legal effect.

If you enter incorrect, incomplete, or out-of-date information — for example, a misspelled beneficiary name, a stale address, an executor who has predeceased you, or assets you no longer own — the resulting document may be ineffective or invalid. We have no liability for any loss, damage, or claim arising from such inaccuracies.

7. Limitation of Liability

To the fullest extent permitted by applicable law, our aggregate liability to you arising from or relating to your use of the Service, the Materials, or these Terms — whether based in contract, tort (including negligence), strict liability, breach of warranty, or any other legal theory — shall not exceed the greater of (a) the total fees you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) two thousand five hundred Canadian dollars ($2,500 CAD).

Under no circumstances shall we be liable to you for any indirect, special, incidental, consequential, punitive, or exemplary damages — including but not limited to lost profits, lost business opportunities, loss of data, loss of goodwill, or reputational harm — whether or not we have been advised of the possibility of such damages, and regardless of the form of action or theory of liability.

The limitations and exclusions in this Section 7 shall not apply to liability arising from our fraud, criminal misconduct, wilful misconduct, gross negligence, or any liability that cannot be limited under applicable law. You acknowledge that these limitations are reasonable in the commercial circumstances contemplated by these Terms and that we have relied on them in making the Service available to you at its current price.

8. Indemnification

You agree to indemnify, defend, and hold harmless MyFareWill, Quietus LLC, and our respective officers, directors, employees, agents, contractors, and licensors from and against any and all third-party claims, demands, suits, actions, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable legal fees on a solicitor-and-client basis) arising from or relating to: (a) your breach of these Terms; (b) your use or misuse of the Service or any Materials; (c) the accuracy, completeness, or legality of any information you provide to us; (d) any claim, dispute, or proceeding brought by a beneficiary, executor, family member, or other third party in connection with a will, power of attorney, or other Material generated through the Service; or (e) your negligence or wilful misconduct.

9. Intellectual Property

The Service and all content (other than the Materials you generate for your own use), including software, text, graphics, illustrations, logos, trademarks, copyrights, photographs, audio, and video, is the exclusive property of Quietus LLC and is protected by Canadian and worldwide intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose and to keep electronic or physical copies of the Materials you generate for your own personal, non-commercial use. You may not reproduce, distribute, lease, sell, modify, reverse-engineer, or create derivative works based on the Service or its components, except to the extent expressly permitted by applicable law or by us in writing.

10. Account, Password, and Device Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not register an email address you do not own. You agree to notify us immediately of any unauthorised use of your account. We bear no responsibility for any harm arising from a third party gaining access to your account, your password, or your device. We strongly recommend using a unique, strong password and enabling any additional security features your account supports.

11. Privacy

Personal information that we collect in connection with your use of the Service will be handled in accordance with our Privacy Policy. By using the Service, you consent to that handling. We may share your personal information with service providers (such as Stripe, Supabase, Vercel, Clerk, and Resend) that are necessary to operate the Service, and with law-enforcement or government agencies as required by law.

12. Acceptable Use

You agree to use the Service only for its stated purposes and in a lawful manner. You will not use the Service in any way that is harmful to yourself or others, or that could be construed as harassment, intimidation, fraud, or a violation of the privacy rights of others. You will not attempt to interfere with, disable, or compromise the Service or any other user's use of it, including by uploading malicious code, scraping the Service, or circumventing security or rate-limit mechanisms. We may suspend or terminate your access if we determine, in our sole discretion, that you have violated this Section.

13. Third-Party Links and Services

The Service may contain links to or integrations with third-party services (for example, FarewellDesk, Stripe, Klarna, DocuSeal). We are not responsible for the content, terms, privacy practices, or operation of any third-party service. Your use of any third-party service is governed by the terms of that service. We make no warranties regarding any third-party service and have no liability for any act or omission of any third party.

14. Warranty Disclaimer

THE SERVICE AND ALL MATERIALS ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL REPRESENTATIONS, WARRANTIES, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND LEGAL EFFECT. NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY US OR ANY OF OUR REPRESENTATIVES SHALL CONSTITUTE LEGAL, TAX, OR FINANCIAL ADVICE OR CREATE ANY WARRANTY.

15. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to acts of God, fire, flood, earthquake, war, terrorism, riot, civil unrest, government action, embargo, strike or labour disruption, pandemic, epidemic, cyber-attack, internet or third-party service-provider outage, or failure of public utilities. The affected party shall promptly notify the other and shall use reasonable efforts to resume performance as soon as practicable.

16. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with (a) the laws of the province in which you reside and the federal laws of Canada applicable therein, if you are a Canadian resident, or (b) the laws of the State of Delaware and the federal laws of the United States applicable therein, if you are a United States resident. In the event of a dispute, you agree that the courts of your province or state of residence are competent to hear the dispute and you agree to be bound by any judgment of that court.

17. Class-Action Waiver

To the fullest extent permitted by applicable law, you and we each agree that any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. If a court of competent jurisdiction determines that this waiver is unenforceable with respect to a particular claim, that claim shall be severed from the remainder of the dispute, and the remaining claims shall continue to be subject to this waiver.

18. General

These Terms constitute the entire agreement between you and us with respect to the Service. They do not create any partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship. If any provision is held to be invalid or unenforceable, it shall be interpreted to give the maximum effect to its intent, and the remaining provisions shall continue in full force.

Section headings are for convenience only and do not affect interpretation. Our failure to enforce any right or provision is not a waiver of that right or provision. We may assign these Terms in whole or in part to any successor in the event of a merger, acquisition, or sale of substantially all of our assets; you may not assign these Terms without our prior written consent.
